Terms and conditions:
Scope of Work
- Preparation and protection of surrounding environment and areas.
- Regular Scope of work is discussed in specifics on the Estimate cover page. Any other work necessary or requested by client shall be included in extras or in addition to the original Estimate. Work, including extras, will be completed at a rate of $75.00/hour plus 20% materials.
- Clean up or all areas affected by the scope of work upon completion.
Additional Notes
- All work will be performed in safe workman like manner in accordance with Ontario Health and Safety Regulations.
- The client will ensure that areas requiring work are free and clear of traffic/trades and obstructions during the work of Castel-Mare.
- Castel-Mare will do all reasonably necessary to protect and preserve areas surrounding work and any adjoining areas of work that may be affected by scope of work, provided that Castel-Mare shall have no liability for any loss or damages resulting to any property or persons save only in the event of the gross negligence of Castel-Mare, provided further and notwithstanding anything herein contained to the contrary, the liability of Caste-Mare will be limited to the repair or replacement only of damaged items and Castel-Mare shall not in any event be liable for consequential damages regardless of how remote.
- Estimate is based in reliance upon information provided by client, and/or determined upon pre-work site visit.
Purchase Order/ Contract – It is the policy of Castel-Mare that we receive a hard copy or written confirmation of the work/contract prior to commencing the work. Email copies are acceptable. Estimate is valid only for 30 days after preparation.
Rental Equipment – If rental equipment is required, the Client will be invoiced for the exact amount of the rental with a copy of the receipt.
Jobsite Delays
- Unnecessary delays in the project due to other trades or sub-trades, or by any other circumstances beyond Castel-Mare’s control, and if this affects in a negative way without proper notice, the time and price will be adjusted and invoiced to the client.
- Castel-Mare is not responsible in the moving of client’s furniture, equipment, supplies or other property from the scope-of-work areas, provided that this must be performed by the client prior to the arrival of Castel-Mare and before the commencement of work. However if it is necessary for Castel-Mare to move furniture, equipment, supplies or other property from the scope-of-work areas, Castel-Mare accepts NO responsibility for any damages that may be incurred, including scratches, breakages, etc.
Clients Responsibilities
The client is responsible to provide the following:
- Minimum Electrical power sources of 110V 15 amp.
- Non-residential clients or large commercial projects must provide: Electrical power sources of, 230V 30amp single phase, 230V 50amp 3 phase, and 600V 50amp 3 phase as well as an electrician to connect power. Adequate lighting must also be provided. (Electrical and Lighting will be discussed between Castel-Mare and client before work begins)
- Furniture and other potential obstacles are clear from the scope of work. For additional information please see Additional Notes under section Scope of Work and Jobsite Delays.
Termination – If the client terminates the project for reasons of its own, and Castel-Mare is not at fault, the client shall reimburse Castel-Mare for unpaid costs of the project and shall compensate Castel-Mare for all costs and profits lost to Castel-Mare incurred in the discontinuing of the work.
Pricing and Payment
- Please note that all prices are subject to H.S.T. The full amount is due immediately upon the completion of the work. If the balance is not is not paid immediately, the remaining balance will accrue interest at the rate of 24% per annum, calculated daily and payable upon demand.
- There are no discounts offered for Cash payments. However if the client wishes to pay in cash, the invoice will still be subject to H.S.T.
- Contracts over $5000.00 not including H.S.T. will be subject to a fee of 20% of the total contract price not including H.S.T. prior to commencing work.
- Service Calls will be invoice at a minimum of $200.00 per visit with the addition of $75.00/hour plus 20% materials after the first hour onsite.
Material and Labour Warranty
- Castel-Mare guarantees all workmanship and materials to be free of defects for a period of one year following completion of the work provided that the account has been paid in full and provided further that normal wear-and-tear is not covered under any warranty after Castel-Mare has completed the work.
- Regarding Sealing and protection of Natural Stone materials, Castel-Mare will recommend how to treat stone but will not be held liable if new stains from acidic or highly alkali substances occur.
Travel
- Castel-Mare requires $0.50/km additional to any work outside of 50km one way, from 42 Goodmark Place, Etobicoke, ON M9W6S2, unless otherwise stated.
- If Airfare is required, this will be discussed and agreed to before commencing work. This will be invoiced upon the completion of work.
- If Hotel and/or Accommodations are required, the cost will be invoiced upon the completion of the project.
